Fees structure

 

Fees, disbursements and explanations relating thereto prepared by MB Mabunda Incorporated.


EXPLANATION OF TERMS

 

 

 

1.1 

Fees are the charges (excluding disbursements) raised by us in respect of professional services rendered by this firm, and which are reasonably necessary in order to give effect to the mandate received by us from you, or to advance your interests, whether pursuant to your specific or general instructions.

 

 

1.2 

Disbursements are, broadly speaking, monies disbursed or payable by us on your behalf, and will include (but are not limited to) counsel’s fees, witness fees (including the charges of expert witnesses), travel expenses, sheriff’s charges, e-mail, revenue stamps, courier charges, photocopying and faxing charges.

 

 

 

1.3 

A fees account refers to fees (excluding VAT) raised by us from time to time and is attached as an annexure to a combined statement / tax invoice and referred to in the body of that statement together with a reference to the VAT attaching thereto. Our fees are as per the private tariff of this firm ("the tariff") to which there is reference hereunder.

 

 

 

1.4 

Postages and petties are costs such as, for example, postage stamps and the cost (disbursement, not fees) of phone calls, all of which in the nature of things cannot be monitored or identified with absolute accuracy. These costs will be raised as a separate globular amount on a fees account in addition to our fees from time to time.

 

 

1.5 

The tariff refers to our attorney and one’s own client tariff (i.e. our private tariff) and fees will be raised by whoever in the firm performs the services in accordance therewith. The fees reflected in the tariff escalate annually on the 01/01 as reflected more fully in clause 8 hereunder.

 

 

2 

GENERAL

 

 

 

2.1 

The firm issues statements of accounts on a regular monthly basis containing details of fees which were raised during the month in question as well as disbursements if applicable ( expensed during the month question.)

 

 

2.2 

Normal Office Hours - are 08h00 through to 16h30, Monday to Friday (i.e., 8 hours without interruption); all work done by us outside normal hours will be charged at 1.5 x our tariff rate, save for work done on Sundays and public holidays which will be charged at 2 x our tariff rate.

Our fees are only charged for the time spent by an attorney the time expanded is charged out at a relevant tariff applicable to the relevant attorney in the firm

 

 

3 

TARIFF OF CHARGES (PRIVATE TARIFF)

 

 

 

3.1 

The charges raised by the following service providers within the firm are based on the following hourly rates (exclusive of Vat) :-

CANDIDATE ATTORNEY R750-900

 

 

3.2 

Where two or more lawyers are involved in a matter, we charge independently for time spent by us on a matter save where we work simultaneously on a matter .

 

 

4 

EXTERNAL SERVICE PROVIDERS

 

It may be necessary for the firm to use an external Service Provider  on behalf of clients so when the firm does so it act as an agent of the client and a contract will be entered into between the client and service provider which will render a client liable directly to the charges of the Service Provider.

5 

DISBURSEMENTS

 

All disbursements shall be charged as follows (exclusive of VAT) :-

 

5.1 

open file fee : R450.00 (plus Vat);

5.2 

facsimiles transmitted : R5.50 per page plus Telkom charge;

5.3 

travelling expenses @ R4.00 per kilometre; parking expenses at actual cost;

5.4 

courier services; the actual charge to us by the outside service provider;

5.5 

photocopies at R2.20 (plus Vat) per page;

5.6 

telephone calls to destinations outside South Africa; the actual cost;
